STATUS REPORT

Plaintiff and Defendants, by their undersigned counsel, submit this Status Report: 1. At a Settlement Conference in June 2008, the parties agreed to a settlement

of this action, and the Court directed the parties to submit a stipulation of dismissal or status report by September 17, 2008. 2. Subsequent to the settlement conference, the parties explored for some time

the possibility of wiring funds directly to Plaintiff in Japan, but this was found to be unworkable. Other arrangements were made and a settlement agreement was signed in August 2008. 3. The settlement payment will be made from the Treasury Department's

Judgment Fund, but that payment has not yet occurred. The Treasury Department is unable to state with certainty a date when the payment will be made, but undersigned counsel for Defendants is hopeful that the payment will be forthcoming shortly. 4. Accordingly, the parties propose to submit, within 30 days of this Report,
