DEFENDANT RODGERICK LACKEY'S UNOPPOSED MOTION TO CONTINUE STATUS CONFERENCE

COMES NOW, the Defendant Roderick Lackey, by and through his CJA appointed counsel, R. Scott Reisch, and hereby moves this Honorable Court to continue the status conference now set for August 8, 2006 at 1:30 p.m. As grounds, Mr. lackey states as follows: 1. On July 27, 2006 the Court issued a Minute Order setting the matter for a

status conference on August 8, 2006 at 1:30 p.m. Undersigned counsel is not available at that date and time. 2. Specifically, counsel will be in trial in Douglas County on a case that has

been continued two times by the prosecution and is one week from speedy trial and is scheduled to commence on August 8, 2006. The trial setting was set prior to the issuance of the Court's Order. 3. If the Court is not inclined to continue the matter, undersigned counsel

would respectfully request that substitute counsel be permitted to appear on behalf of undersigned counsel. Specifically, Charles W. Elliott would appear for counsel. Mr.

Elliott is an experienced criminal defense lawyer as well as a CJA Panel member and will have undersigned counsel's available calendar dates. 4. Further, Mr. Lackey would request that his appearance be waived at the

status conference on August 8, 2006. Mr. Lackey has made that request due to issues at the FCI Englewood where he is being held. 5. Undersigned counsel has spoken with Assistant United States Attorney

David M. Conner regarding this motion and he has no objection to any of counsel's requests; that being to continue the status conference, for Mr. Elliott to appear on counsel's behalf and waiving Mr. Lackey's presence. WHEREFORE, Mr. Lackey respectfully requests that the status conference on August 8, 2006 at 1:30 p.m. be continued or that substitute counsel be permitted to appear on behalf of attorney R.
