Herringer, Greenberg, Herringer & Ward, LLC, on behalf of Defendant Leland Jeremy Lopez, and Suneeta Hazra, Assistant United States Attorney, on behalf of the Government, and hereby jointly request they be allowed to appear telephonically at the Status Conference in this matter, currently scheduled for Thursday, March 30, 2006 at 2:45 p.m. Both Mr. Herringer and Ms. Hazra are appearing in the United States District Court, Durango, at a four-day Jury Trial in the United States of America v. Johnson Kenneth Taylor, United States District Court Case No. 05-CR-103 JAP. Therefore, Mr. Herringer and Ms. Hazra respectfully request that this Honorable Court allow them to appear at the Status Conference scheduled for March 30, 2006 at 2:45 p.m. by telephone or, in the alternative, respectfully request that this Honorable Court continue the Status Conference to a date both parties are able to Plaintiff,

appear. Counsel for Mr. Lopez has discussed this motion with the attorney for the Government and is authorized to state that Ms. Hazra joins in this motion. WHEREFORE, Defendant and the Government pray for that this Honorable Court allow their requested appearance at the Status Conference scheduled for March 30, 2006 at 2:45 p.m. by telephone or, in the alternative, that the Court continue the Status Conference to a date when both counsel can appear.
