THIRD AMENDED SCHEDULE A RIDGES BASIN DAM AND RESERVOIR ANIMAS-LA PLATA PROJECT

AUTHORITY FOR THE TAKING The authority for the taking of the real property described herein is pursuant to and in accordance with the Act of August 1, 1888 (25 Stat. 357, as amended, 40 U.S.C. 257 (1982)); the Act of June 17, 1902 (32 Stat. 388), and all acts amendatory thereof or supplementary thereto (32 Stat. 388, 43 U.S.C. 371 et seq., (1982)); the Act of February 26, 1931 (46 Stat. 1421, 40 U.S.C. §§ 3114 (formerly 40 U.S.C. § 258a)); Act of August 4, 1939, Section 14 (53 Stat. 1197; 43 U.S.C. § 389); the Act of April 11, 1956 (70 Stat. 105 43 U.S. C. 620, et seq., (1982)), and all Acts Amendatory thereof or supplementary thereto; Public Law 90-537, Colorado River Basin Project Act, Title V, September 30, 1968 (82 Stat. 896); the Colorado-Ute Indian Water Rights Settlement Act of 1988 (102 Stat. 2973); Public Law 106-554, Colorado Ute Settlement Act Amendments of 2000, dated December 21, 2000; and H.R. 2419, Public Law 109-104, Energy and Water Development Appropriations Act, 2006, dated November 19, 2005. PUBLIC USES The Public Uses for which the Perpetual easements and Temporary easements are being taken are: A. To relocate certain easements, previously owned by Northwest Pipeline Corporation, that were required to be relocated in order to construct the Animas-La Plata Project; B. To relocate certain easements, previously owned by Mid-America Pipeline Company, that were required to be relocated in order to construct the Animas-La Plata Project; C. To construct, reconstruct, operate, inspect, repair, protect, and maintain a pipeline or pipelines by Northwest Pipeline Corporation, its successor The Williams Companies, Inc., and its successor(s); D. To construct, reconstruct, operate, inspect, repair, protect, and maintain a pipeline or pipelines by Mid-America Pipeline Company, its successor Enterprise Products Partners L.P., and its successor(s); and E. To construct, reconstruct, operate, inspect, repair, protect, and maintain the Inlet Conduit for Ridges Basin Dam and Reservoir, Animas-La Plata Project, and its associated facilities and operations, including but not limited to power line(s) and communication facilities. The Perpetual easements and Temporary easements on, over, across, and/or under the real property have been selected for acquisition by the United States for the aforesaid purposes and 1

uses, and for such other purposes and uses as may be authorized by Congress or Executive Order. The immediate possession of the Perpetual easements and Temporary easements on, over, across, and/or under the real property is required for the use by the Bureau of Reclamation, United States Department of the Interior, its employees, contractor(s), agents, and assigns.
