Pursuant to Local Rule 40.1(e), Defendant Pizza Hut, Inc. ("Pizza Hut") discloses

2 that the above-entitled action is related to another action, Noni Gotti v. Sweetwater 3 Associates, LP., et al., Case No. 37-2008-0006991-CU-CR-SC, pending in Superior 4 Court of California, County of San Diego, before Judge William S. Cannon, filed on 5 April 14, 2008. 6

The instant action and the Gotti action involve the same defendants, the same
