Pursuant to this Court’s order of February 7, 2007, defendants move fer summary
judgment dismissing Counts I and HI ofPiai1itiffs’ Second Amended Complaint. The reasons
for this motion are set forth in the Opening Brief filed contemporaneously herewith. Nothing
herein is intended as a waiver ef the arguments made by defendants in support ef their tirst
motion for summary judgment to dismiss piaintiffs’ remaining eiaims nor is anything herein
intended as a waiver of defendants arguments that they are entitled tn official immunity and
various state law immunities.
