Chesney presiding. Parties appeared through their respective counsel. After considering all the papers and admissible evidence submitted by the parties in support of and in opposition to the Motion to Dismiss, and the arguments of counsel in connection with this matter, and good cause appearing therefor, the Court finds that Plaintiff's Complaint fails to state a claim upon which relief can be granted, on the grounds that: (1) all of plaintiff's claims are preempted by the Employee ­1­

IT IS HEREBY ORDERED that Defendant's Motion to Dismiss Plaintiff's Complaint is Granted.

The Complaint therefore is dismissed, without leave to amend.
