I, Eric Ball, declare as follows: 1. I am an attorney licensed to practice in California and before this Court. I am an
associate with Fenwick & West, and counsel for plaintiff Intel Corporation ("Intel") in this matter. I submit this declaration in support of Intel's Request for Entry of Default Against

Intelsys Software, LLC. I have personal knowledge of the facts stated herein and, if called as a witness, I could and would testify competently thereto. 2. Intelsys Software, LLC ("Intelsys") is a limited liability company registered in
Washington State, and hence not an infant, in the military, or an incompetent person. On its website at www.intelsysus.com, Intelsys promotes itself as doing business within the Northern District of California. 3. Attached hereto as Exhibit A is a true and correct copy of Intel's Complaint

against Intelsys Software, LLC for damages and injunctive relief under the Lanham Act (15 U.S.C. §§ 1051-1127 et seq.), federal false designation of origin law (15 U.S.C. § 1125(a)), the Trademark Dilution Revision Act (15 U.S.C. § 1125(c)), California Business and Professions Code Sections 14245, 14247, and 17200, and the common law doctrines of passing off and unfair competition ("Complaint"). 4. The Complaint was served on Intelsys Software, LLC on August 1, 2008 at its
