19 WHEREAS on May 16, 2008, Plaintiffs served a Complaint alleging infrngement
20 of six patents and a declaratory judgment action alleging non-infrngement and invalidity of seven

21 patents; and
22 WHEREAS on June 5, 2008, Defendants-Counterclaimants fied an Answer and
23 Counterclaim alleging infrngement of six patents and a declaratory judgment action alleging
24 non-infrngement, invalidity and unenforceability of six patents; and

25 WHEREAS Plaintiffs and Defendants-Counterclaimants (collectively "the
26 Paries") have executed a Standstil Agreement and agreed to stay the litigation for a period of

27 time. The Standstil Agreement wil allow the parties to explore the possibility of resolving the
28 dispute without litigation and avoid the costs associated therewith.

NOW, THEREFORE, THE PARTIES STIPULATE AS FOLLOWS:

Subject to the Cour's approval, the above-captioned matter is stayed until

3 December 17, 2008.

Upon termination of the stay or at an earlier date as may be agreed upon by

5 the Parties, if the Paries are unable to resolve the dispute, they wil jointly contact the Court to
6 schedule a new date for the Initial Case Management Conference.

7 ACCORDINGLY, the Parties respectfully move the Court for an Order as follows:

The Initial Case Management Conference scheduled in this matter for

9 September 8, 2008 is vacated;

2.

The above-captioned lawsuit is stayed until December 17, 2008, unless an

11 earlier date is agreed to by the Paries; and

3.

Upon termination of the stay or at an earlier date as may be agreed upon by

the Paries, if the Paries are unable to resolve the dispute, they wil jointly contact the Court to
