IT IS HEREBY STIPULATED AND AGREED by and among Plaintiff Benitec
Australia Ltd. ("Benitec"), Defendant and Third Party Plaintiff Promega Corporation
("P1·omega") and Third-Party Defendant Commonwealth Scientific and Industrial Research
Organisation (“CSIRO") (collectively, the "Parties") that pursuant to Fed. R. Civ. P. 4l(a) and
(c) and a settlement agreement among the Parties this action shall be dismissed with prejudice
and without costs to any Party. By this Stipuiation, the Parties respectfully request dismissal of
this action with prejudice.
