I am responding to the letter of Russell Stlherglied about the confusion concerning the above
_ captioned appeal Although I have not had the benefit oi reviewing the dodtet or consulting with
the clerks ofnce, my copiw of docketing information suggest the pcssioitty there ana two separate
pro se appeals, l would guess that the appellant in Case No. 0 l—CV~0'7 18 is Patricia A. Stalano. I

November I, 2001 . It this is correct, ivls. Staiano may have never received notification that her
appeal had been docketect or that a motion had been tiled to dismiss her appeal.
I do not believe that the doctrine of equitable mootness should apply to my appeal., My brief,
which was tiled on November 22, 2002, addresses the mootness issue. For this reason, i
submit that the Court should maintain its brlellng order but provide the appellee additional
time to tile their brief,
l am forwarding copies of all correspondence and my copies the two Notice of Docketing
statements to the clerks oftice Hopefully the added information will lead to a detinitive
resolution
