Dear Applicant: Thank you for contacting us and expressing your interest in using the Bucking Horse & Rider (BH&R) mark. The BH&R mark is a Federal and State registered trademark of the State of Wyoming, therefore its use must be monitored. The State of Wyoming Secretary of State's Office requires that all uses of this trademark be approved and they have directed our office to handle such approvals. These approvals help insure that the BH&R trademark is fully protected on behalf of all Wyoming residents and businesses. I am enclosing a business use agreement for your review and signature. There are no fees for this agreement. This agreement grants your business/organization the right to use the BH&R mark on business signage, letterhead, business cards, websites, etc, royalty free. Use of the BH&R mark on promotional or commercial items (i.e. t-shirts, mugs, etc.) will be subject to royalties and need to be produced by an authorized product licensee of the State. The process is as follows: If the enclosed agreement is acceptable, please sign and return it to our office along with a detailed description of how you propose to use this BH&R mark (i.e. business cards, website, etc.). If acceptable, we will notify you and make electronic files of the BH&R mark available. However, please note that a finished sample must still be submitted to this office to complete this process. (A photograph may be acceptable.) Submit a finished sample. Once a finished sample has been received and approved a Business Use certificate will be sent confirming our approval to use the BH&R trademark on those items listed on the agreement. APPROVAL TO USE THE "BUCKING HORSE & RIDER" TRADEMARK IN BUSINESS SIGNAGE, BUSINESS LOGOS AND BUSINESS ADVERTISING The State of Wyoming (Owner), grants (Business), having its place of business at _________________________________________________________, approval to use the "Bucking Horse & Rider" trademark in its business signage, business logos and/or business advertising, without charge, under the following conditions: (a) Business, as a condition to the granting of this approval, agrees to indemnify and hold harmless and release and forever discharge Owner, and its trustees, agents, officers and employees, either in their individual capacities or by reason of their relationship to the Owner and its successors, from any and all claims and demands whatsoever which Business and any or all other persons have against the Owner, or any or all of the above-mentioned persons or their successors, by reason of any damage, or other consequences arising or resulting directly or indirectly from the use of the "Bucking Horse & Rider" trademark in its business signage, business logos and/or business advertising. (b) Business agrees that in the exercise of its rights under this approval, it will not state or imply either directly or indirectly that Business or Business's activities, other than those required by this approval, are supported, endorsed, or sponsored by Owner. Business also agrees not to use the name of Owner in its business or affairs other than in the performance of its rights and obligations under this approval. (c) Business agrees that it will not alter, modify, dilute or otherwise misuse the "Bucking Horse & Rider" trademark, or bring the trademark into disrepute. Business also agrees to not violate any federal or state trademark law, and maintain the same level of quality that exists at the time this agreement is signed. (d) Business acknowledges Owner's right, title and interest in and to the "Bucking Horse & Rider" trademark, and will not in any manner represent that Business has any ownership therein, and will not knowingly in any way do or cause to be done any act or thing contesting or in any way impairing any part of such right, title and interest. Business therefore agrees, except for the rights granted herein, not to register or attempt to register, in any jurisdiction, the "Bucking Horse & Rider" trademark. (e) Since the "Bucking Horse & Rider" trademark is federally registered by Owner, Business agrees, whenever possible, to place the Federal registration designation "®" beside the "Bucking Horse & Rider" trademark in a visible manner as shown below. (f) Business understands that this approval does not authorize Business to manufacture, or otherwise utilize, the "Bucking Horse & Rider" trademark on products that are intended to be sold, offered for sale or sold. Such use will require a separate licensing agreement. (g) This approval shall have no automatic expiration date, but all rights hereby granted may be revoked and terminated at any time by Owner without cause on sixty (60) days written notice. (h) The "Bucking Horse & Rider" trademark consists of a silhouette design of a cowboy figure holding a cowboy hat and riding on a bucking horse, or any likeness thereof that is confusingly similar to the trademark shown on the next page:
