3 1. 1 am a resident of Burlingame, California, an attorney at iaw duly admitted to
4 practice before the state and tederal courts of California, , and a partner at Nixon Peabody LLP,
5 attorneys of record for Carl Zeiss Meditec, inc. ("CZMI"). The facts set forth herein are based
6 upon my own personal knowledge, and if called upon to testify, I could and would testify
7 competently as follows.
3 2. Nixon Peabody LLP is not currently invoived in any patent prosecution for CZM1.
9 3. In the event that Nixon Peabody LLP is, in fact, retained by CZMI for the purposes
