Q - Plaintiff, an inmate in the Sant. Rita lail, filed this pro se civil rights complaint ` .
pursuant to 42 U.S.C. § 1983, alleging that jail officials allowed him to be assaulted by E
( I » another inmate, resulting inserious injuries to plaintiff, in violation of the Eighth _ ·
V Amendment. _
‘ On luly 26, 2007, this Court issued an Order that directed defendants to file a
dispositive motion and provided that plaintiff’s opposition to defendants’ motion for
summary judgment "shall be filed with the Court and served on defendants no later
than thirty (30) days from the defendants’ motion," pursuant to Federal Rule of Civil
Procedure 56. (
V l A Defendants Sheriff’s Technician Richardson and Sheriff Gregory Ahern filed a I
motion for sumimary judgment on October 24, 2007. The grounds for the motion were
that plaintiff could not establish deliberate indifferenceon part of Sheriff’s Technician '
Richardson and that Richardson was entitled to qualified immunity. .
