E I I Plaintiff, a state prisoner, filed the present ggrgg prisoner complaint under 42 U.S.C. § 1983.
gl § I2 On May 23, 2007, mail directed to Plaintiff by the Court was returned to the Clerk of the Court with
fg LE 13 a notation that it was undeliverable. To date, Plaintiff has not updated his address with the Court or
E 14 submitted any further pleadings in this case.
§ $5 15 Pursuant to Northern District Local Rule 3-I l a party proceeding _tg whose address
§ Fg 16 changes while an action is pending must promptly tile a notice of change of address specifying the
E FE 17 new address. & L.R. 3-1 l (a). The court may, without prejudice, dismiss a complaint when: (1)
E 18 mail directed to the j party by the court has been returned to the court as not deliverable, and
l9 (2) the court fails to receive within sixty days of this return a written communication from the p
20 party indicating a current address. E L.R. 3-11(b).
21 More than sixty days have passed since the mail directed to Plaintiff by the Court was
22 retumed as undeliverable. The Court has not received a notice from Plaintiff of a new address.
23 Accordingly, the complaint is DISMISSED without prejudice pursuant to Rule 3-1 1 ofthe Northern
24 District Local Rules. The Clerk of the Court shall enter judgment in accordance with this Order,
25 terminate all pending motions, and close the file.
