On 1/4/02 the defendant, present with counsel, appeared for sentencing for violating Title 21, USC §841(a)(1)&(b)(1)(B)(vii);18:2: Possession with Intent to Distribute Marijuana; Aid and Abet, a Class B Felony offense, as charged in the Indictment filed herein. The defendant was sentenced to a term of TWENTY FOUR (24) MONTHS imprisonment and upon release, FIVE (5) YEARS of supervised release to follow. On 1/3/05 the United States Attorney filed a petition to revoke the term of supervised release, and on 6/15/05 a superseding petition was filed. On 8/19/05 the defendant appeared with counsel and admitted the allegation as reflected in the superseding petition to revoke filed in this matter. The matter now comes on for disposition.

IT IS ORDERED that the term of supervised release imposed on 1/4/02 is hereby REVOKED and the defendant
is committed to the custody of the Bureau of Prisons for a term of FOUR (4) MONTHS, with no supervised release to follow. Disposition imposed shall run consecutive to the sentence imposed in CR-05-440-TUC-FRZ.

IT IS FURTHER ORDERED that the defendant is given credit for time served.

The Court orders commitment to the custody of the Bureau of Prisons The defendant previously waived the right to appeal.
