CR 01-011-1 PHX-SRB ORDER REVOKING SUPERVISED RELEASE

A petition for revocation of supervised release having been filed and hearings held with the defendant and counsel present, and the defendant having previously admitted violation of special condition #8, IT IS ORDERED revoking the defendant's supervised release and the defendant, James Brian Nardi, shall be committed to the custody of the Bureau of Prisons for a term of SIX (6) MONTHS. IT IS FURTHER ORDERED upon release from the Bureau of Prisons, defendant is placed on supervised release for a period of FORTY-EIGHT (48) MONTHS. IT IS FURTHER ORDERED the Defendant shall pay a $100.00 special assessment and restitution in the amount of $6,598.00 to be paid jointly and severally with the codefendant in this case to victim Bank One, with credit for monies paid to date. Payment of criminal monetary penalties are due during imprisonment at a rate of not less than $25.00 per

quarter, and payments shall be made through the Bureau of Prisons Inmate Financial Responsibility Program. IT IS FURTHER ORDERED affirming standard conditions of supervision adopted by the Court in General Order 05-36 previously imposed. The Defendant shall comply with the following additional conditions: 1. You shall participate as instructed by the probation officer in a program of substance abuse treatment which may include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by the probation officer. 2. You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable manner. 3. 4. 5. You shall provide the probation officer access to any requested financial information. You are prohibited from owning, maintaining or using a firearm. You shall abstain from all use of alcohol or alcoholic beverages. The defendant is remanded into the custody of the United States Marshal Service. The defendant is advised of his right to appeal within 10 days. DATED this 24th day of May, 2007.
