IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA

Defendant, Jose Cruz-Hernandez, by and through undersigned counsel, respectfully requests that this Court continue the Sentencing/Disposition Hearing currently set for October 17, 2005. The reason for this request is that counsel needs time to complete presentence investigation. Defense counsel spoke with Assistant U.S. Attorney, Joseph E. Koehler he has no objection to the continuance. This is the second extension requested to this court. This motion is made in good faith and not for purpose of delay. Excludable delay under 18 U.S.C. § 3161(h)(1)(F) and (8)(A) may occur as a result of this motion or of an order based thereon.
