I . 23 Pursuant to the Court Order dated May 23, 2007 and A.R.S. § 12-341, BNSF
24 submits its itemized statement of costs attached as Exhibit A. The Court has ruled that the
25 Industry Track Agreement between BNSF and Chemical Lime requires Chemical Lime to
2 6 defend and indemnify BNSF from and for plaintiffs claims. BNSF has therefore

ZL submitted all the costs it incurred in defending itself against plaintiffs claims and
2 prosecuting its claims against Chemical Lime. BNSF respectfully requests that the Court
