I MOTION TO DISMISS PLAINTIFF’S COMPLAINT
2 Defendant Joseph L. Williams ("Williams”), hereby moves to dismiss this

4 action pursuant to Fed. R. Civ. P. l2(b)(1), 12 (b)(2) and 12 (b)(6). Plaintiff fails to
5 state claims for which relief can be granted and, in any event this Court lacks
6 jurisdiction to hear plaintiffs’ claims. The reasons supporting this motion are set forth
7 in more detail in the accompanying Memorandum of Law and attached exhibits.

9 THEREFORE, defendant respectfully requests that the instant motion be
10 GRANTED and that this action be DISMISSED.
