The current date for discovery cutoff is September 23, 2005, and the deadline for

15 dispositive motions and motions in limine is October 28, 2005. As outlined in KBI's 16 Motion to Dismiss (docket 35), despite its efforts, defendant has been unable to obtain 17 either written or oral discovery to date. Although KBI will continue its attempts, even if 18 plaintiff were to cooperate at this point, KBI would not be able to complete the discovery 19 necessary to its defense in the next three weeks. 20 As such, KBI respectfully requests that the Court extend the discovery cutoff date

21 to November 11, 2005 and extend the deadline for dispositive motions and motions in 22 limine to December 22, 2005. 23 24 25 26 27 28
