Pending before the Court is Plaintiff's "Emergency Motion Requesting to Add to

Exhibit 10 to His Response to Defendants Filed Motion for Summary Judgment Dated

12/14/05" (Doc. # 207). Plaintiff requests that the Court allow Plaintiff to supplement
18

his Response to Defendants' Motion for Summary Judgment (Doc. # 200) with
19

additional information that Plaintiff avers demonstrates that his grievances have been
20

administratively exhausted.

Plaintiff maintains that he was unable to locate this

information until February 24, 2006 and submitted it immediately for consideration. Because Plaintiff recently filed his Response, and he did not delay in submitting the
23

documents when he located them, Plaintiff's motion will be granted.

IT IS ORDERED that Plaintiff's "Emergency Motion Requesting to Add to Exhibit
25

10 to His Response to Defendants Filed Motion for Summary Judgment Dated
26

12/14/05" (Doc. # 207) is GRANTED.
