Local Rule of Civil Procedure 54Ja is clear: a party must submit its bill of costs within ten days after the entry of final judgment. The deadline for filing a bill of costs in this case was February 27, 2007. Id.; Fed, R. Civ. P. 6a. Plaintiff filed his bill of costs more than two weeks late. Plaintiff's only excuse for his untimely bill of costs is that the Court set a March 16, 2007 deadline for filing post-trial motions, such as Defendants' Motion for Judgment as a Matter of Law and Motion for New Trial and Plaintiffs Motion for Attorneys' Fees. A bill of costs, however, is not a "post-trial motion" that is filed with the Court for the Court's consideration. Instead, a bill of costs is filed with and

considered by the Clerk of the Court. L. R. Civ. P. 54.1a, b both the requesting party and the objecting party "file with the Clerk of Court". The Court does not even review a bill of costs unless one of the parties timely objects to the Clerk's taxation of costs. Fed. R. Civ. P 54b. The Court did not extend the time to file a bill of costs. As the cases cited by Defendants in their Motion to Strike make clear, the ten day filing requirement is a mandatory deadline. Plaintiff failed to comply with the Rule, and his untimely bill of costs should be stricken. DATED this 2nd day of April, 2007. STEPTOE & JOHNSON
