The Court rules on pending motions as follows: Dft. Woodcock's Motion to Compel Production (doc. 227) is granted to the extent that Mr. Shimko will be required to file a document by Tuesday, August 19, 2008 describing what he is claiming in this case. Dft's Woodcock's Motion for Sanctions (doc. 227) is taken under advisement and will abide the outcome of the trial. Plaintiffs' Motion for Leave Until August 12, 2008 to File Proposed Pretrial Statement (doc. 229) is granted. Plaintiffs' Motion for Leave Until August 13, 2008 to Respond to Dft. Woodcocks' Motion to Compel and Motion for Sanctions (doc. 231) is granted. Plaintiffs Motion to Permit Richard Hricik to Participate at the August 15, 2008 Final Pretrial Hearing Via Phone (doc. 239) is granted. The parties Stipulation to a Bench Trial (doc. 242) is accepted by the Court. 3:19 p.m. Mr. Hricik is no longer present by telephone. Mr. Shimko indicates that he will proceed without him.
