LaBarge, and respectfully requests that the court continue the Sentencing currently set for September 28, 2005 for a period of thirty (30) days. This motion is based on the following grounds: 1) Defense counsel will be in trial on September 28, 2005 before the Honorable Neil V. Wake in the case of USA v. Sergio Pizano-Garcia, CR04-1082-PHX-NVW. 2) Defense counsel has contacted both AUSA Richard Suzuki and USPO Mike Lipscomb, and neither has any objection to this request. 3) Defense counsel has filed this same date an Ex Parte Motion to Determine Counsel, or Alternatively to Withdraw. Additional time will be needed to resolve the issues raised in that motion.
