The motion of Darius M. Nickerson, Esq., lll West Monroe, Suite 1500,
Phoenix, Arizona 85003, (602) 254-0004, to withdraw as appellant’S appointed
counsel is granted. Appellant's motion for appointment of new counsel is granted.
New counsel will be appointed by separate order.
The Clerk shall serve a copy of this order on Jon Sands, Federal Public A
Defender, 850 West Adams Street, Suite 201, Phoenix, Arizona 85007, who will
locate appointed counsel. The district court shall provide the Clerk of this court
with the name and address of appointed counsel facsimile transmission (FAX: 0
(415) 556-6228) within 14 days of locating counsel.
New counsel shall designate the reporter’s transcript by November 1, 2005.
The transcript is due December 1, 2005. Appellant’s opening brief and excerpts of
record are due January 10, 2006; appel1ee’s answering brief is due February 9,
2006; and the optional reply brief is due within 14 days after service of the
answering brief

According to the Bureau of Prisons Inmate Locator, appellant’s registration
number is 68806-198 and his location is in-transit. Accordingly, within 21 days
after the date after this order, appellee’s counsel, Gary M. Restaino, Esq., shall
sewe this order on appellant and file proof of such service with this court showing
appellant’s address.
The Clerk shall serve this order on former counsel.
