Hearing held re: Defendant's Motion for Psychological Examination [45]. On 4/13/05 (docket no. [56]), the Court ordered the defendant, Dennis B. Gaytan, be committed to the custody of the Attorney General for treatment in a suitable facility. The Court is in receipt of the report prepared by Bradley Norlander, M.A., and Drs. Jill R. Grant, Alyson R. Kuroski-Mazzei and Bruce Berger dated 2/13/06, a letter by Mr. Randy S. Eternick, Acting Warden, FCC, Butner (Medical), dated 2/27/06, and Certificate of Competency dated 2/28/06, regarding the abovedefendant. The doctors opine that the defendant is now competent to proceed. Based upon the doctors' report and findings, the Court finds that the defendant has completed his period of commitment and is now mentally competent to stand trial, understand the legal proceedings against him and assist an attorney in preparing his defense. All time is excluded from date treatment was ordered (4/13/05) through today (3/20/06). IT IS ORDERED setting trial on Tuesday, May 2, 2006 at 9:00 a.m. in Phoenix, Arizona. The Court is advised that plea negotiations are on-going and counsel expect to resolve this case prior to trial. OTHER: IT IS ORDERED that the Forensic Evaluation dated 2/13/06 be filed under seal.
