15 challenging the lawfulness of the charged deportation at any time during the trial, to include voir 16 dire, examination and argument. This Court has already denied defendant's collateral attack on 17 the charged deportation. A collateral attack allegation is for the Court alone to decide, and it is 18 not a matter for the jury to decide. United States v. Alvarado-Delgado, 98 F.3d 492, 494 (9th 19 Cir. 1996). 20 For the foregoing reasons, the government moves for an order precluding defendant from 21 challenging the lawfulness of the prior deportation during the trial of this matter. 22 23 24 25 26 27 28 Respectfully submitted this 29th day of August, 2005.
