16 statement of the case: This case involves allegations that on or about January 12, 2003, on the 17 18 Gila River Indian Community, the defendant, William Kevin Domingo, an Indian, 19 assaulted Lawrence Samuel Kisto, and Hubert Evans Jr., and Russell Blackwater Sr. 20 with a machete and a handgun, and that in addition, that Mr. Domingo caused the 21 death of Theopholis James while trying to kill another person. Finally, Mr. Domingo 22 has been charged with several charges of use of a firearm.
