IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA United States of America, Plaintiff, v. William Domingo, Defendant. No. CR-04-1100-PHX-DGC ORDER (Fourth Request)
Upon motion of the defendant, the government not objecting, and good cause appearing therefore, IT IS HEREBY ORDERED granting defendant's Motion to Continue Trial pursuant to 18 U.S.C. § 3161(h)(8)(A) and (1)(F). This court specifically finds that the ends of justice served by granting a continuance outweigh the best interest of the public and the defendant in a speedy trial. This finding is based upon the court's conclusion that the failure to grant such a continuance would deny the defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(B)(iv). IT IS FURTHER ORDERED continuing the trial date from September 13, 2005 to November 8, 2005, at 9:00 a.m. in Phoenix, Arizona. IT IS HEREBY ORDERED extending the time to file pretrial motions to September 16, 2005. ....
