COMES NOW Defendant, Jose Juan Collazo Ibarra, by through undersigned counsel, and

respectfully moves this Court to continue the trial date, which is set for October 1 1, 2005, for a period
17
of sixty (60) days. The reason for this motion is that there is an extensive amount of discovery that has
18
to be reviewed and plea negotiations are ongoing.

Defense counsel’s office has contacted all the co—defendant’s attorneys and the U.S. Attorney,
20
Emory Hurley, conceming this motion and none of them have an objection to a continuance.

It is expected that excludable delay under Title 18, United States Code, Section 3161 (l1)(1)(F)

will occur as a result of this Motion to Continue Trial and Extend Motion Deadline and order based
