IT IS HEREBY ORDERED granting [164] Defendant Preston's Motion to Continue terms of the pretrial diversion agreement,

additional time needed for defendant to complete the pretrial diversion program and meet the

Trial. This court specifically finds that the ends of justice served by taking this action

22 outweigh the best interest of the public and the defendant in a speedy trial. This finding is 23 based on the court's conclusion that the failure to grant such a continuance would 24 unreasonably deny the attorney for defendant the reasonable time necessary for effective 25 preparation, taking into account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(B)(iv). 26 IT IS ORDERED continuing trial from June 5, 2007, to Tuesday, February 5, 2008 27 28
