The United States hereby responds to Defendant Bella Ben-Henry's Motion to Strike Surplusage From Indictment. The government does not oppose striking the language regarding sentencing factors from the indictment in this case. Specifically, the language on from page 4, line 18, through page 5, line 1, may be stricken. Under United States v. Booker, 125 S.Ct. 738 (2005), the jury no longer is required to make those determinations because of the advisory nature of the Sentencing Guidelines.
