REPLY RE MOTION FOR REVIEW OF AGENT PERSONNEL FILES OF AGENTS HEALFERTY AND KOLLAS (Assigned to the Hon. Frederick J. Martone)

At the outset, it must be noted that it was the Government that chose to declare Nora Kollas and Julie Healferty as expert witnesses. Once the Government designated them as expert witnesses, the Government's obligation to provide information came to a higher level of scrutiny. The defendants do not have any significant amount of comfort by having the Government supervisor from a law enforcement agency reviewing a personnel file. It is respectfully requested that the personnel file of Julie Healferty and Nora Kollas be reviewed by the Office of the United States Attorney and any potential Brady Material be provided to the defendants. Not only is this a relatively simple procedure, but it assures the compliance with the Constitutional requirements of Brady v. Maryland, 373 U.S. 83 (1963.)
