Defendant, Brandi Lynn McCrory, through undersigned counsel, asks this Court to continue the trial date for a period of thirty (30) days from the current date of September 13, 2005. The reasons for the requested continuance is that the parties have reached a tentative pretrial disposition and are anticipating a change of plea. The parties have already represented on the record this date that a change of plea set before a magistrate is agreeable to both sides. Defense counsel has communicated with the Assistant United States Attorney's office concerning this motion, and the government, through Andrew Pacheco, has no objection to the requested continuance. Excludable delay under 18 U.S.C. §3161(h)(8)(A) may result from this motion.
