CR 04-752-PHX-NVW ORDER

A Petition for Revocation of Supervised Release was filed and Defendant admitted the allegation that he violated Standard Condition # 3. The Court found that defendant violated the terms and conditions of supervised release. The Court has considered the U.S. Sentencing Commission Chapter 7 policy statements as well as the original guideline range and 18 U.S.C. ยง3553 and finds as follows: IT IS THE JUDGMENT OF THIS COURT THAT defendant's supervised release is REVOKED. IT IS ORDERED committing defendant to the custody of Bureau of Prisons for a term of SEVEN (7) MONTHS, with credit for time served in custody on this matter. IT IS FURTHER ORDERED sentencing defendant to a term of TWENTY-NINE (29) MONTHS Supervised Release upon defendant's release from custody.

SUPERVISED RELEASE Within 72 hours of release from custody of the Bureau of Prisons, you shall report in person to the Probation Office in the district to which you are released. You shall comply with the standard conditions of supervision adopted in General Order 05-36 and the following additional special conditions: 1. You shall participate as instructed by the probation officer in a program of substance abuse treatment which may include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by the probation officer. You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable manner. You shall reside and participate in a residential re-entry center for 180 days, unless discharged earlier by the probation officer. You shall not contact the following victim(s), Samuel Pechuli, and the probation officer will verify compliance. You are prohibited from owning, maintaining or using a firearm. You shall abstain from all use of alcohol or alcoholic beverages. IT IS FURTHER ORDERED affirming all priors orders concerning fines, restitution, and assessment. IT IS FURTHER ORDERED dismissing the remaining allegations of the Petition to Revoke. Defendant is advised of his right to appeal. DATED this 7th day of August, 2008.
