22 such evidence, if any, is substantially outweighed by the danger of unfair prejudice, confusion

In On cr abcut April 29, 2{i[l3, Defendant was arrested by cfficers af the United
1] States Marshal’s Service and was subsequently charged with Unlawful Pessessicn af Firearms,

E gg § 13 Pcssessicn cf a Firearm Nct Registered in the Natianal Firearms Registraticn and Transfer
E Reccrd, in vielaticn cf Title 26, United States Cade, Sectiens 5E6l(d) and SETI. Defendant’s
§ éélil § 16 arrest fcllawed a search nf a fear hedreern hcuse in which he was living lacated at l3tJl7·’ N.
E jg 3t]th Street in Phceaix, Atialcua. Defendant lived in the heuse aleng with three ether ycung

3 The infermatien allegedly pessessed by the efiicers is hearsay based en an
4 apparent eut-ef-ceurt statement frem an unidentified declarant and is therefere inadmissible
5 under Rule St}2 ef the Federal Rules ef Evidence. The “infbrmatien" dees net fall within any
6 ef the hearsay ertceptiens set ferth in Rules SH3 and El]4. Further, the “inferrnatien" lacks any
7
circumstantial guarantees eftrustwerthiness and therefere is net admissible under Rule St}?.
