COMES NOVIF PROBATION OFFICER Melissa A. Sullivan presenting an ofhcial report on Jesus
Enrique PORTELA-ACOSTA who was committed to the Bureau of Prisons on June 14. 2004, by the
Honorable Roslyn O. Silver presiding in the District Court of Arizona. A two year period of supervised
release was imposed, and supervision commenced upon the offenders discharge from imprisonment
on May 9, 2006. In addition to the general terms and conditions adopted by the Court, the offender was
ordered to comply with the following special conditions:
I 1. lf deported, you shall not re-enter the United States without legal authorization.
Jesus Enrique PORTELA-ACOSTA was convicted of illegal reentry after deportation. B USC §1326(a)
and (b)(2), a Class C felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
Allegatlon A. Violation of Standard Condition No. 1:·You shall not commit another federal, state
or local crime during the term of supervision.
On or about January 11 , 2008, PORTELA-ACOSTA committed the new federal offense of re-entry after
deportation, a Class C felony. This is evidenced by a complaint tiled January 14, 2008, in the District
of Arizona, Tucson, case no. 08-07500M. Court proceedings are pending. Grade B Violation,
§7B1.1(a)(2). · _
Allegatlon B. Violation of Special Condition No. 1: lf deported, you shall not re-enter the United
States without legal authorization.
On or about January 11, 2008, PORTELA-ACOSTA entered the United States without legal
authorization. This is evidenced by his January 11, 2008, arrest by Border Patrol Agents at or near
Nogales. Arizona- This arrest was subsequent to his May 10. 2006, deportation. Grade C Violation,
§7B1.1{a)(3).
