UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America Case No. 03-06153M (DKD) Plaintiff, v. Clarence Frederick Conway, Defendant. The United States of America, by and through undersigned counsel, hereby moves this court to dismiss the pending criminal complaint in this matter pursuant to F.R.Crim.Pro. 48(a). The government charged the defendant on July 2, 2003. The parties were pursuing a pretrial/preindictment resolution in this matter that required the defendant to pay restitution to the victim in full. The defendant did so on May 4, 2005. As a result, the defendant has complied with all agreements with the government and the government now moves to dismiss the pending charges with prejudice.
