18 André H. Merrett, being duly sworn upon his oath, deposes and states as follows: i
19 l. On or about May 25, 2006, I attempted to contact defendants to arrange a
20 conference for the purpose of satisfactorily resolving any dispute that defendants may
21 have relating to Best Western’s attorney’s fees. In this respect, I attempted to contact Mr.
22 Roesing at his last known address and telephone number. Additionally, I attempted to
23 contact Gorham Rutter, a lawyer with whom Mr. Roesing has been consulting throughout
24 this action. I have been unsuccessful in contacting Mr. Roesing or Mr. Rutter.
25 2. Because neither Mr. Roesing nor Mr. Rutter would respond to my
26 correspondence or telephone messages, the conference did not occur.
