Dillie, et al, the Court issued an Order approving settlement agreements between the Receiver and the following defendants: Renald J. Bidwell, Richard Derk, Orville Dale Frazier, Ronald Kerher, and John Rada. The Receiver was directed to file a motion dismissing these defendants in CV 03-2390-PHX-JAT, Warfield v. Alaniz, et al. The Court notes that on September 12, 2006 (Doc. #518), Plaintiff filed a Motion to Dismiss Ronald Kerher. The Court granted the motion on October 31, 2006 (Doc. #541). The record further reflects that at trial on February 14, 2007, the parties advised the Court in open court that a settlement agreement had been reached as to defendant Dwight Lankford as set forth on the record. The Court made a finding that the proposed settlement was fair and reasonable. To date, plaintiff has failed to file motions to dismiss the following defendants: Renald J. Bidwell, Richard Derk, Orville Dale Frazier, John Rada, and Dwight Lankford.

Further, the Court records reflect that the following defendants have not been resolved in this case by default, settlement or dismissal: Ron Rodriguez, Candes Rada, George Satter, and Mildred Yonan (spouse Raymond Yonan dismissed 1/13/05).
