The parties provide notice to the Court that they have reached a settlement in this matter and have entered into a written settlement agreement which will dispose of all claims in this matter. Among the terms of the settlement, defendant Robert Dieleman is required to deliver a crane to plaintiff Mardian on or before November 30, 2005. If that does not happen, the parties have agreed that Mardian may take judgment against the defendants for possession of that crane. For that reason, the parties request that this matter be kept open until December 15, 2005. On or before that date, the parties will either file a stipulation for dismissal or a stipulation for entry of judgment pursuant to the parties' settlement agreement.
