Dear Don:
In response to our telephone conversation last week, it is our position that
the Agreement called for interest to start at the time it was entered. Judge Campbell
found that to be Spring, 2002. At the latest, it was March, 2002, as reflected by the e-
mails between Mr. Gooch and me. Through the end of this month (November), that
would mean there is 3.75 years of interest due and owing. The Agreement also stated the
interest would be compound. Further, our position is the interest rate is 10 percent, the
statutory rate in Arizona. Our fees as of November 9, 2005 are $188,92100. Our costs
as of November 9, 2005 are $9,964.66. Thus, the following is the breakdown:
Judgment = $500,000.00
Interest = $214,813.22
Fees = $188,921.00
Costs = $9,964.66
TOTAL = $913,698.88
This is the amount we believe Golden Eagle now owes. Please pass this
