Defense shall produce notes of Colleen Connor for review by plaintiff. 10:32 a.m. Recess. 10:47 a.m. Reconvene. Colleen Connor resumes the stand and testifies further. 11:54 a.m. Recess. 1:30 p.m. Reconvene. The jury is not present. Matters are discussed regarding Plaintiff's Motion to Strike testimony of Colleen Connor as stated on the record. For the reasons stated more fully on the record, Plaintiff's Motion to Strike is denied. 1:45 p.m. The jury is now present. Colleen Connor resumes the stand and testifies further. Exhibit Nos. 79 and 69D are received in evidence. Witness is excused. 2:55 p.m. Recess. 3:10 p.m. Reconvene. Todd Lang is sworn and examined. Witness is excused. Defense rests. No rebuttal by Plaintiff. 4:02 p.m. Jury is excused until 9:00 a.m. on 9/22/2005. Court stands at recess. 4:16 p.m. Reconvene. Jury Instructions are settled and verdicts prepared. The issue as to punitive damages having been taken Under Advisement, the Court now grants the defendant's motion for judgment as a matter of law with respect to the punitive damage claims. 6:10 p.m. Recess.
