Plaintiffs Crane Co. ("Crane") and Unidynamics/Phoenix, Inc. ("Unidynamics") and
20
Defendant United States of America (the "United States’) jointly move this Court to enter the
21
attached Consent Decree. On November 13, 2003, Plaintiffs filed a complaint in this matter
22
pursuant to Section 113 of the Comprehensive Environmental Response, Compensation, and
23
Liability Act ("CERCLA"), 42 U.S.C. § 9613, seeking contribution from the United States for its
24 . `
equitable share of response costs that Plaintiffs have incurred or may incur in connection with the
25
releases and threatened releases of hazardous substances at P1aintiffs’ facility in Goodyear,
26 _ _
Arizona (the "Contribution Claims"). By order of the Court, Plaintiffs’ Contribution Claims were
27
consolidated with the United States' July 8, 2004 complaint, on behalf of the Administrator of the
28
United States Environmental Protection Agency ("EPA"), against Crane and Unidynamics w
ase 2:O3—cv—O2226-ROS Document 83 Filed O7/26/2006 Page 1 of 2

1 pursuant to Sections 106 and 107 of CERCLA, 42 U.S.C. §§ 9606 and 9607 (the "Enforcement
2 Claims"). These actions have proceeded under the above consolidated caption.
3 On June 27, 2006, the Court entered a Partial Consent Decree resolving the Enforcement
4 Claims. The parties now have negotiated a settlement of the Contribution Claims, which will
5 become effective upon entry of the proposed Decree. As elaborated in the parties’ joint
6 memorandum of law, the proposed Decree is fair, reasonable, and consistent with the purposes of
_ 7 CERCLA. Therefore, for the reasons set forth herein and in the accompanying memorandum, the
8 parties respectfully move this Court to approve, sign, and enter the attached Consent Decree.
