Discussion held re: jury demand. The Court finds the demand is not timely and is deemed waived. The parties advise this is a one day bench trial. Plaintiff's failure to disclose potential witnesses and exhibits on the joint proposed pretrial order is discussed. The Court directs plaintiff to file a supplemental pleading entitled exhibits and list each document specifically so defense counsel can have notice and can advise the Court on the day of trial any objections to said exhibits Scheduling of trial date discussed. Once the Court can determine its schedule for the balance of this year, the Court's staff will advise the parties of the trial date, which may be set in the first three weeks of December 2005. Defense counsel is to file a notice of unavailability of witnesses so the Court can schedule the trial accordingly. The Court approves the parties' Joint Proposed Pretrial Order. A copy of the exhibit marking instructions is provided to the parties this date.
