1 Spencer ("Defendants"), by and through undersigned counsel, hereby submit
2 their Statement of Facts in Support of Defendants’ Motion for Summary
3 Judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure and Local
4 Rule 1.10(l)(1).
5 1. Plaintiff Jesse Cabana was arrested and booked into the Maricopa
6 County Sheriff’s Ofhce ("MCSO") Maricopa County Jail System on December
7 14, 2002. (See Exhibit Affidavit of Margaret DiFrancesco, 1] 5.)
8 2. On October 10, 2003, Plaintiff Hled a Complaint in the Federal Court
9 for the District of Arizona. (PIaintiff’s Complaint, Pg. 1.) The Complaint alleged
10 six counts of constitutional violations by the Defendants in overseeing the
11 operation of the Maricopa County Madison Street Jail. (PIaintiff’s Complaint.)
12 However, the Court dismissed Counts l, II, IV, V, and VI of the Complaint on
13 March 29, 2004. (Order of the Honorable James A. Tielborg, dated March 29,
14 2004).
15 3. In Count lll of his Complaint, Plaintiff alleges that the Defendants
16 violated his Fourteenth Amendment rights on three separate occasions when
17 they placed him on the nutraloaf diet. Plaintiff alleges that placing him on the
18 diet constitutes punishment for which he was not allowed a hearing nor an
19 opportunity to appeal. (Complaint, Page 6, 1] 3.)
20 4. Plaintiff seeks injunctive relief in the form of an order by the Court to
21 Defendants to do a variety of things. included in the request for injunctive relief
22 is a request to the Court to order the Defendants "to refrain from placing

1 detainees on the loaf diet as a sanction for punishment without due process and
2 for violations not related to food infractions." Additionally, Plaintiff requests the
3 Court order the Defendants "to refrain from depriving Plaintiff of his religious diet
4 as a sanction for disciplinary punishment while also denying plaintiff out of cell
5 time for weeks and months without due process." (Plaintiffs Complaint, Pg. 7.)
6 5. Plaintiff was released from the custody of the Maricopa County Jail
7 system on March 31, 2005. (Affidavit of Margaret DiFrancesco, 1[ 5.)
8 6. Plaintiff is currently sewing a life sentence in the Arizona
9 Department of Corrections prison system. (Exhibit "B", March 18, 2005 minute
10 entry of Maricopa County Superior Court Judge Gary E. Donahoe, Page 2.;
11 Exhibit "C", Arizona Department of Corrections Inmate Detail of Jesse Cabana.)
