1. This Honorable Court has scheduled a hearing on the issue of whether defendant Holt should be release from confinement as a result of his contempt on February 22, 2006 at 1:30 pm. 2. The Commission requests this Court's leave to participate in the aforesaid hearing via telephonic means. The Commission has contacted all counsel of record in this matter, and each has authorized the Commission to inform this Court that they have no objection to the Commission participating in the hearing via telephonic means. 3. The Commission is able to make appropriate arrangements to participate by telephonic means, and no cost to this Court or any party hereto.
WHEREFORE, Plaintiff Commodity Futures Trading Commission requests this

Honorable Court grant this motion to participate in the February 22, 2006 via telephonic means, and grant Plaintiff Commodity Futures Trading Commission such further and additional relief as this Honorable Court deems just and appropriate.
