ig . Sto1 . gg 5, 2006, the United States Court of Appeals for the Ninth Circuit reversed this Court’s
20 decision and remanded the case with an order to grant Stol l 2] habeas corpus as to his claim that the sentencing judge violated Stol 22 pursuant to Apprendi v. New Jersey, 530 U.S. 466 (2000), by enhancing Sto1 6 23 sentence based on a judicial finding of aggravating circumstances. Stokes v. Schrim,
_- 24 465 F.3d 397, 404 (9th Cir. 2006).
_ 25 Based on the foregoing, I » I
26 IT IS HEREBY ORDERED that Stokes’s petition for Writ of habeas corpus
27 is GRANTED as to that claim and DENIED as to all other claims. The State of
_ 28 Arizona shall vacate and set aside Stokes’s sentence and, at a miniinurn, the state

1 I court shall- conduct a status conference Ito schedule Stokes’s resentencing within
2 ninety days of the entry of judgment. The Clerk of Court shall enter judgment
