Pending before the Court is Plaintiff Lexcel Solutions, Inc.'s Motion for Partial 17 Summary Judgment (Doc. #101). In its Motion, Lexcel requests that the Court enter 18 summary judgment in its favor on Defendants MasterCard International, Inc. and MasterCard 19 International, L.L.C.'s (collectively, "MasterCard") defense of waiver. On March 23, 2005, 20 the Court granted Lexcel's Motion to Strike MasterCard's affirmative defense of waiver. 21 Accordingly, 22 IT IS ORDERED Lexcel's Motion for Partial Summary Judgment on the defense of 23 waiver (Doc. #101) is DENIED AS MOOT. 24 25 26 27 28 DATED this 9th day of September, 2005.
